This paper analyzes the advantages and disadvantages of the current Marijuana Enforcement Policy in New York City. It describes the legislation, civic norms, and etiquettes being promoted. This includes a clear delineation of the specific policies NYPD has been enforcing, with a focus upon arrests and detention for about 24 hours. The potential benefits of this enforcement policy (relatively little public marijuana smoking, compliance with civic norms) are compared with the disadvantages (ethnic disparities, focus upon low income communities, criminal record accumulation, etc.). Several specific recommendations for changes in NYPD marijuana control policy are made with a focus on reducing short-term detention, ethnic disparities, and criminal record accumulation—while also maintaining widespread user compliance with civic norms against public marijuana smoking. |
