The paper studies how institutional rules and norms of the Supreme Court and Circuit Courts affect how judges choose among competing modes of reasoning. The case study is immigration cases from two time periods and from the two different courts. I conclude that the Supreme Court and Circuit Courts operate in decidely different instituional contexts which in turn affect the way they decide cases. |

| judicial hierarchy a case progresses ironically the less concerned about justice the judges become. This research project has several important theoretical implications for the study of judicial behavior immigration law and institutional development. One of those includes a call for the reevaluation of the factors that influence judicial decision-making and more specifically the manner in which decision-making is tied to institutional contexts.
