An Exploration of the Relationships Between Children's Rights and Justice |

The past century has seen an exponential increase in “justice” for American children including juvenile courts in every state, attorneys for children, limitations on child labor, massive state and federal agencies to protect children, law school courses of study regarding various aspects of “pediatric law,” the development of enforceable children's quasi civil rights and growing calls for children's rights in private and public fora. “Children's rights” is a capacious phrase encompassing both children's positive rights, needs, voice and interests and adult rhetoric designed to promote various social norms and notions of justice. This paper seeks to disaggregate the notion of “children's rights” by tracing the origin and operation of those children's rights and interests that are legally defined or enforceable and then assessing the types or conceptions of justice these rights and interests serve. The paper finds that nearly all formulations of children's rights have elements that acknowledge or compensate for children's dependency, but those rights and interests that are rooted in dependency are the least liberatory and most amenable to the subordination of adult and child members of non-dominant groups. The paper suggests a conception children's rights that is grounded in larger notions of social justice. |
