Abstract
As political pressures for the inclusion of more faith-based organizations in the public bid process mount, legislators and administrators need a clearer picture of the strengths and weaknesses of this approach to service delivery. The ability of potential contractors to operate in a constitutionally appropriate manner is part of that picture.
It seems reasonable to assume that familiarity with the law construing the religion clauses would be an important indicator of the ability of faith-based contractors to adhere to constitutional constraints. This article reports the results of a survey to measure what congregational leaders know about the First Amendments religion clauses. |

Twelve of the states had no one officially responsible for constitutional oversight.52 In the absence of mechanisms for ensuring constitutional as well as fiscal accountability public policy in this area is likely to be made through litigation rather than through administrative processes.
