Abstract:

Through an examination of state public utility commissions (PUCs), I begin in this paper to explore the complex systems of control over water supply in the United States. PUCs are semi-independent state agencies whose primary function is to regulate utilities that provide electricity, natural gas and telephone service. All but seven PUCs also regulate various types of water suppliers. The specific types of water suppliers that fall under the jurisdiction of PUCs varies widely. Because PUC control over water varies so widely between states, an examination of PUCs can begin to shed light on the circumstances that determine who or what has control over water.

By this definition the regulation and administration of water should be a government function. Aquifers watersheds and other water resources present significant hurdles to exclusion

I now end the paper with a series of fundamental questions that this paper has not even begun to answer regarding the impact that variations in state controls over water have on state water supplies.
