Abstract:

In this paper I will examine intellectual property rights as an example for a contested source of power in the international political economy. The claim that knowledge and scientific or technological progress are a source of power is not new. A common means for measuring this kind of resource has been to count the number of patents granted. This way patents – as an example of intellectual property – have been used for measuring the power resource technological knowledge. While I agree that patents can tell us something about power I disagree on the question of why this is so. The central claim of this paper is that patents and other forms of intellectual property are not simply an expression of technological power. They rather constitute an emerging source of global power themselves. While intellectual property rights are not a recent phenomenon, their intensification and globalisation through international agreements such as the TRIPs agreement of 1994 and the WIPO treaties of 1996 are. Since intellectual property rights as a power resource are dependent on a legal framework establishing these rights they remain inherently contestable.
