Rehabilitation for a New Generation: Drug Courts and the Logic of Coerced Treatment

Abstract:

This paper examines the social and historical significance of coerced drug treatment within the criminal justice system. Drug courts, the most prominent example of this approach, serve as a case study to explore how seemingly contradictory approaches to substance use – therapeutic and punitive – are merged to justify an increased role for the courts in solving social problems. Drawing on an analysis of drug court documents, interviews with key drug court advocates, and published accounts of drug court practice, I will 1) discuss how medicalized theories of addiction and recovery are used to justify increased court supervision of drug-related offenders and 2) examine how the logic of coerced treatment reflects both the rehabilitative and repressive approaches that have characterized U.S. criminal justice policy throughout the 20th and early 21st centuries. Overall, I will consider how advocates of coerced treatment combine moral and medical considerations in the name of an “enlightened” approach to the problem of chronic substance use.
