Domestic Violence as Proxy: Gender Wars, Justice Policy, and the Use of Battered Women

Abstract:

Over the past few decades, we have progressed from the long-held view that condoned or ignored domestic violence, to a recognition that it is a criminal justice and policy issue that demands public attention. However, with greater state involvement, has come concern that battered women are being denied the ability to make independent choices for their future, and their safety. This paper examines the legitimate concerns that must be addressed from within the battered women's movement, while also exploring how conservatives, men's rights advocates, and "pseudo-feminists" are attempting to exploit divisions within the movement to promote broader public policy and criminal justice agendas. The paper concludes with suggestions for improving public response to domestic violence, without permitting these regressive groups to use battered women for their own purposes.
