The Impact of Distrust on the Implementation of Trade Laws: The United States and Post-Communist States |

Abstract:

This paper will examine the impact of distrust on the implementation of trade remedy laws and trade agreements between the United States and former Communist countries. The United States has continued to discriminate against trade with former Communist countries long after the end of the Cold War. It is not just China that bears the brunt of the U.S. distrust. Russia, Ukraine, Eastern Europe, and other former Soviet Republics also face unusually high impediments to trade negotiation and facilitation. Why? This paper will demonstrate how continued distrust of these countries affects the implementation of trade in the post-Cold War period.Specifically, this paper will examine the extent to which the U.S. follows through on its anti-dumping trade remedy policy initiatives with respect to former Communist countries. Trust affects the extent to which trade partners will follow through on their promises. This paper examines the implementation phase, or what happens after an agreement on trade has been reached. It focuses on distrust rather than trust. Distrust is not the absence of trust; it is an antagonistic feeling or impression one has of the other, in this case a trading partner. I examine how distrust affects the implementation of formal rule changes. I look at the case of U.S. trade with former Communist countries in order to demonstrate how distrust causes the U.S. to break its formal rule commitments and interpret trade policy implementation in a manner inconsistent with existing trade agreements. |
