Abstract:

This study explores discretionary decision making among parole agents. Key in this process are constructed tipifications of parolees and decision frames that emerge from agent-parolee interaction. The findings emerge from in-depth interviews conducted with parole agents in the California Department of Corrections and Rehabilitation (CDCR) Adult Parole Division, 500 hours of direct observation of parole agent interaction with peers, supervisors and parolees and an examination of institutional data. The study raises questions about the role of relational factors in legal decision-making and carries implications for understanding the normative stages of discretion in criminal justice contexts.
