From Arrest to Sentencing:The Criminal Justice System Processing of White-Collar and Common Economic Offenders

Abstract:

Much literature suggests that white-collar offenders are treated more leniently than nonwhite-collar economic offenders in the criminal justice system. The bulk of this research has focused on sentencing differentials and finds that white-collar defendants receive less harsh sanctions than comparable nonwhite-collar defendants, both in terms of the in/out prison decision and sentence length. The present study extends this line of research by utilizing both arrest and sentencing data from Florida in order to place the sentencing decision within the wider perspective of criminal justice system processing. Regression analyses are employed to compare the demographic and criminal involvement characteristics of white-collar (embezzlement, forgery, and fraud) and common (burglary and robbery) economic offenders in an attempt to identify which point in criminal justice system processing—arrest or sentencing—exhibits the greater degree of disparity.
