The Effect of the Prison Litigation Reform Act on Judicial Intervention in U.S. Correctional Facilities |

The Prison Litigation Reform Act of 1996 placed numerous limitations on inmates’ right to file suit against correctional facilities for civil rights violations. These limitations include exhausting all available administrative remedies available at the facility, restrictions on the use of in forma pauperis filings, and the loss of “good time” for multiple filings resulting in dismissal. The significant reduction in inmate litigation filing rates since the enactment of the PLRA calls for an examination of the merit of suits not filed or immediately dismissed by the courts. I evaluate the decline in the number of correctional facilities under court order or consent decree between 1995 and 2000 to determine if the reduction is a function of higher standards for court processing imposed by the PLRA or the improvement of correctional facility characteristics. |
