Abstract:

This essay maps and deconstructs the argumentative strategies deployed for and against proposed constitutional amendments on the definition of marriage in eleven states in 2004, finding evidence that on both the pro-amendment (anti-same-sex marriage) and especially the anti-amendment (pro-same-sex marriage) side of the debate, accommodationist and relatively peripheral arguments displaced would-be central assertions of contention, showing that the debate over same-sex marriage was significantly and unfortunately more reflective of cultural peace than warfare, and that the continued reification of the “culture wars” appellation unfairly penalizes the pro-same-sex marriage side and precludes constructive reflection on the meaning of marriage and the transformative goals of sexual liberation
