Gubernatorial Influence in Elective States: Examining Interim Appointments to Courts of Last Resort |

Most of the literature on judicial staffing in elective states makes only passing reference to the importance of interim appointments made by governors to fill vacancies. Interim appointments, however, serve as the avenue of ascension for slightly more than half of all high court judges in the states that allow governors this power. Previously, we found wide variation in the prevalence of interim appointments from one state to the next (Holmes and Emrey 2005). In this study, we examine why governors have varied opportunities to fill vacancies in otherwise elective states, and as well examine why some judges are more likely to be appointed rather than elected to the bench. A more thorough understanding of interim appointments will provide important insight into the staffing of the judiciary in states generally thought of as being purely “elective.” |
