Appraising the Assessment Process of Criminal Court Functionaries: The "Córdoba Model" in Argentina--A Case Study |

Under the influence of global neoliberal policies and the “neo-institutionalism”, in Latin América, a second wave of “law and development” programs has focused on the reform of national and local justice systems. The following are among their main alleged objectives: to attract foreing investment, to strengthen the independence of the judicature and to favor more and better access to justice. These reform programs, with the support of transnational financial organizations, such as the World Bank and IDB, address their efforts to several flaws of the judicature, one of the most important being the process of selection and promotion of human resourses. The so called “Córdoba Model” (applied since 1996 by the High Court of the Province of Córdoba, Argentina) has been one of the leading programs for the transformation and modernization of the system of assessment, selection and promotion of judicial functionaries.
This paper critically analyses the results of the ten year implementation of the new system of assessment of Provincial Criminal Courts’ functionaries in Córdoba City. Data sources of this research work are based, on the hand, on the regulatory norms which shape the system and, on the other hand, on the opinions of Criminal Courts’ functionaries selected/promoted by the new system. |
