NOTE: The title of this paper changed during the writing process. It is now: "Making or Breaking Kosovo: The Case for Non-Territorial Autonomy."
The international policy community’s recent efforts to resolve Kosovo’s status have focused almost exclusively on the province’s independence from Serbia. But independence for Kosovo will not serve as a panacea. Rather, it would likely endanger the province’s Serbs and destabilize the region through emulation and spillover effects. In its drive for independence, the international community has ignored innovative governance options for divided states. Policy discussions have focused on governance along a territorial, rather than a functional principle – but minorities will always be at some disadvantage in territorial units. For this reason, non-territorial autonomy and functional control structures have been successfully applied to address problems of governance in divided states such as Belgium. A growing theoretical literature on these structures illustrates the promise of functional, rather than territorial, controls to incorporate minorities into governing institutions in troubled places such as Kosovo. |
