Abstract:

The paper considers whether it is legitimate for liberal democracies to extend a full set of minority language rights to national minorities and a restricted set to immigrants. The best-known attempt to justify treating immigrants and national minorities differently is Will Kymlicka's consent theory. This theory has beebn widely criticized in the literature, and the present paper reviews some of the standard objections. But the aim of the paper is to rehabilitate the consent theory by showing that a suitably revised and elaborated version of the consent theory can counter the standard objections.
