This paper reports the results of a mail survey of 178 state court trial judges from Texas, Michigan, Indiana, and Arizona about their use of and opinions about court-appointed experts. Their reasons for choosing or declining to exercise their inherent power to appoint experts, the kinds of expert testimony most frequently seen by the judges in this sample, judges’ views of the costs and benefits associated with using court-appointed experts, and judges’ perceptions of court-appointed vs. privately-retained experts will be discussed in the context of implications for judges, attorneys, and experts. |
