Abstract:

Scandinavian welfare states are regularly described as being universal, public, equal and supporting strong redistributive efforts among citizens. The Scandinavian legal cultures are to a certain extent based on the assumption that all citizens are included in the social infrastructure of the welfare state. However, social justice and redistribution in the welfare states are heavily influenced by perceptions of normality and ideal social requirements for citizenship. The subjects and conditions that are included in the social citizenship are determined in a qualification process based on rights and obligations. Law is thus part of this ongoing process of designing social citizenship and of articulating normality.

As Scandinavian welfare state law will be problematized from the perspective of equality, participation and social justice for people with disabilities, important questions arise on redistribution versus recognition. To make social citizenship a good tool for analyzing social justice for people with disabilities, more than inclusion in and exclusion from the redistributive efforts of the welfare states must be considered. Social justice and social citizenship as analytical tools need to recognize participation and empowerment of the individual as important aspects of the social citizenship. The aim will be to take a more comprehensive approach to social justice and social citizenship.
