Abstract:

International labor standards provide that workers have the right to form or join labor organizations "without distinction" -- that is, irrespective of their legal status, whether documented or not. In the United States, cases such as the Supreme Court's decision in Hoffman Plastic Compounds Inc. v. NLRB (2002) would seem to have seriously undermined this right. This paper will compare how the U.S. regime, including but not limited to Hoffman Plastics, is similar to and different from international standards.
