Switching between Legal Cultures: Multicultural Transnational Lawyers

Abstract:

Lawyers whose identity is partly connected to Islamic legal cultures and partly to modern legal cultures, make use of their actual and virtual networks in connecting both worlds. A growing number of these multicultural lawyers act as transnational lawyers. They are able to act as mediators in disputes which have a root in conflicting legal cultures, for example in international business transactions, but also in troublesome cases in the field of family law. These lawyers use their ‘double cultural knowledge’ of local customs and legal peculiarities, and by switching between legal cultures try to reach an attainable result while at the same time ‘save the face’ of the people giving in.

In this paper we will present the preliminary findings of an empirical research on the ‘legal common senses’ of multicultural transnational lawyers. We will especially focus on multicultural transnational lawyers acting as mediators in cases of child abduction to and from Islamic countries that did not sign the Treaty on the Rights of the Child. Even in these extreme cases however, multicultural transnational lawyers seem to be able to bridge the gap and take care of a ‘happy ending’. We propose to see this ability as a talent to switch between legal cultures, and we explore their behaviour in relation to the standards of the legal profession in order to find out what ‘extra’s’ they have.
