Human Smuggling and Human Trafficking: International Law and Governance |

Abstract:

The issues of human smuggling and trafficking in persons have received substantial attention from national governments and international organizations during the past decade. At the international level the legal framework for addressing these highly related problems is the United Nations Convention against Transnational Organized Crime and its protocols: the Protocol to Prevent, Suppress, and Punish Trafficking in Persons, Especially Women and Children; and the Protocol against the Smuggling of Migrants by Land, Air, and Sea. Responsibility for addressing human smuggling and trafficking is trifurcated, with important roles assumed by 1) agencies with law enforcement mandates, such as the UN Office on Drugs and Crime and Interpol, 2) organizations with human rights mandates, such as the UN High Commissioner for Human Rights, UNICEF and the International Labor Organizations, and 3) organizations with international migration mandates, such as the International Organization for Migration and the UN High Commissioner for Refugees. The paper will explore these institutional responses and their consistency with what is widely regarded as the best strategies for addressing smuggling and trafficking: prosecution of smugglers and traffickers, protection of the victims, and prevention of the phenomena. |
