Deference to International Law: Origins and Functioning of Legal Obligation in International Politics

Abstract:

Extant research has failed to appreciate legal obligation as a compliance motive. Even though states since World War Two have created about fifty thousand agreements, it remains unexplored whether these instruments actually invoke a sense of legal duty. Are actors in international politics ever motivated to follow legal rules because they recognize the authoritative claims of law and take law as a reason for action? This study examines the origins and functioning of legal obligation. I advance a theoretical framework to explain the antecedent conditions of legal obligation and develop testable hypotheses about how a sense of legal duty comes into being and influences behavior. I test the implications of the theory by examining macro patterns of compliance with contentious court decisions and by analyzing micro processes of compliance decision making. The results offer support for the theoretical model and show that legal obligation as a standing compliance motive increases the overall propensity to abide by law even when compliance entails critical sacrifices. Empirical analysis also provide evidence the framework of antecedent conditions and account for why actors differentially recognize law’s authoritative claims.
