Revisiting the Policy Preferences of United States Courts of Appeals Judges

Abstract:

Despite recent advances in public law scholarship and political methodology, scholars still lack sophisticated data on the United States Courts of Appeals and the policy preferences of the judges who serve on them. To remedy this deficit we estimate circuit court judges' ideal points using measurement techniques that have gained widespread acceptance in a variety of contexts, including the estimation of Supreme Court Justices' policy preferences. We apply these methods by examining every dissenting opinion written by a federal circuit court judge from the Circuit Court of Appeals for the District of Columbia between 1925 and 2006 (N=2615). We use our estimated ideal points to pursue two empirical tasks. First, we compare our estimates to those generated by the Judicial Common Space, finding important differences between them. Second, we test our measure in the context of modeling separate opinion writing on the D.C. Circuit.
