Racial Diversity on State Courts: The Effects of Selection Methods upon Representation of Black and Hispanics Judges |

The discussion of racial diversity and judicial selection methods has gone relatively unnoticed. The discussion is based on whether the selection method, appointed, merit or elections affect racial diversity on state courts. While there has been an extensive amount of literature written on judicial selection methods among the states there seems to be little scholarly literature addressing the effects which the selection method has had upon racial diversity on the state courts._x000d_The focus of this research is to discern any varying effects on; appointment, merit selection and elections on racial diversity on state benches. In particular the effects of judicial selection method on the number of Black and Hispanic judges on state courts will be addressed. All levels of state judiciaries, trial and appellate are included for this particular analysis. Data will be used from 1994, 1997, 2005 and 2008. The research addressed here is intended to further the discussion of whether state judicial selection methods effect the racial diversity of the state courts. |
