Abstract: This paper will provide a comparative analysis of the factors that led to success versus failure in international environmental treaty negotiations. The two cases reviewed are the Montreal Protocol negotiations on ozone layer depletion and the Kyoto Protocol negotiations on global climate change. In both cases I will use the following factors as a means of evaluating the success of the Montreal Protocol and the failure of the Kyoto Protocol negotiations at the time these negotiations took place. The factors are: the role of science; the power of knowledge and of public opinion; the activities of multilateral institutions; an individual nation's policies and leadership; the role of private sector organizations; the negotiation process; and the flexibility and dynamic of the treaty instrument (Benedick, 1998).
