Abstract: Several studies of judicial impact have argued that the impact of Roe v. Wade in increasing access to abortion has been largely mitigated by theextent to which the decision mobilized New Right opposition. These arguments dovetail with the critiques of rights litigation and discourse which argue that rights claims tend to be more "divisive" and less likely to produce consensus than legislative policy changes. These claims, I argue, are not grounded in significant empirical evidence. I argue that policy changes achieved through litigation do not tend to generate more opposition than changes of commensurate magnitude achieved through the legislative process. A careful comparison of the reaction to the liberalization of abortion law in state legislatures before Roe and the reaction subsequent to Roe does not support the null hypothesis that litigation is more "divisive" than legislation.
