Abstract: Following democratization and the 1988 Constitution, the expansion of judicial review in Brazil was conceived as a mechanism to increase control of a strong federal government by civil society institutions and regional political groups, including state governors. The latter have become one of the most frequent initiators of constitutional challenges. However, rather than focusing on protecting state autonomy vis-à-vis the federal government, state executives have consistently challenged laws passed by their own legislatures. Why governors often sue their own legislative bodies? What factors explain the use of this instrument to solve state-level conflicts? Although some anecdotal evidence suggest that this might be associated with the executive’s strength in state legislatures, no empirical work has yet investigated the recourse to the federal judiciary for resolution of intra-state disputes. This works uses interviews with state actors, newspaper articles on controversial disputes, and quantitative data on electoral outcomes to investigate and test the explanatory power of three factors: governmental control of legislature, formal institutional power of each political branch and state’s socioeconomic characteristics.

Abstract: Results of a survey addressing bureaucratic neutrality and merit practices in an ethnic federalism, Ethiopia, are presented. Implications for bureaucratic neutrality in a government facing challenges of legitimation and ethnic conflict are examined.
